 6. Procurement, Shipment and Fulfillment

 6.1 Partner with DHL Express Commerce and Colissimo

We have partnered with Colissimo (Greece, Portugal, Italy and Spain) and/or DHL Express Commerce (all other countries) to manage the end-to-end procurement process of our products. When you place an order, Global-E will handle the fulfillment and delivery process.

By placing your order to purchase one or more Products (each, an “Order”) through the checkout, you confirm that you have read and understood these Terms of Sale and the Privacy and Cookies Policy available at: Privacy Policy and: Cookies Policy (which are available on the footer the margys.com website) (together, “Terms”) in their entirety, as well as the Privacy Policy, Cookies Policy and terms of use of Margy’s Monte Carlo available on the Online-Shop (what you’re reading now), and you agree to be bound by them. These Terms define your legal relationship regarding the checkout, the placement of Orders, and the purchase of Products underlying such Orders.

If you do not agree to the Terms, please do not complete your Order.

These Terms are entered into force in the English language and governed by it. You agree that any translation, if provided, is available for your convenience only (unless otherwise required by applicable law).

 6.2 Shipping Terms

Shipping terms, including delivery times, shipping costs, and any applicable customs duties, will be specified at the time of purchase. DHL and/or Colissimo terms and conditions will apply to the shipping services they provide.

6.3 Notice bonded storage fees
Bonded storage fees may apply if the goods are not collected within 48 hours after customs clearance.

6.4 Import Verification & Bonded storage fees
Bonded storage fees may apply if customs authorities contact the customer for import-related verifications and no response is provided within 48 hours.

7. Loyalty Program – Terms of Membership

The loyalty program "The Club" offered by Margy’s Monte Carlo is reserved for customers who register on our website and place at least one order. Membership is free and valid for an initial period of 12 months starting from the first purchase made after registration.

At the end of this period, Margy’s Monte Carlo will evaluate the total amount spent by the customer on the website. Each Swiss Franc (CHF) spent earns one loyalty point. Based on the total points accumulated, appropriate gifts will be sent to reflect the customer’s tier.

Margy’s Monte Carlo reserves the right to modify the terms of the program, the reward tiers, or the gift delivery process at any time, without prior notice. Any attempt to manipulate or misuse the program may result in immediate termination of membership.

 8. Liability/Exemption

To the fullest extent permitted by law, Margy’s Monte Carlo disclaims all warranties, express or implied, regarding the website and its use. We do not warrant that the website will operate error-free or that the website and its servers are free of computer viruses or other harmful material. We shall not be liable for any damage of whatsoever nature arising from the use of this website. You agree to assist Margy’s Monte Carlo in the judicial and extrajudicial resolution of such disputes with third parties, while Margy’s Monte Carlo retains the exclusive right to litigate and the right to conclude judicial and extrajudicial settlements.

Margy’s Monte Carlo is not obligated to verify that your user content does not potentially infringe the rights of third parties and/or violate the law. However, Margy’s Monte Carlo has the right, at any time and without explanation or notice, to refer, not publish, modify, shorten, and/or delete, in whole or in part, your user content from its websites, social media channels, and/or other online media if, in Margy’s Monte Carlo’s opinion, it does not comply with these terms of use, particularly if it is unlawful. Users are required to respect the rights of others, comply with the law, and adhere to good morals.

These Terms are governed by and construed in accordance with the laws of Swiss Confederation excluding United Nations Convention on Contracts for the International Sale of Goods, without prejudice to mandatory provisions, particularly the law of the state in which you usually reside, insofar as you are a consumer. You agree that any legal action or proceeding between Margy’s Monte Carlo and you for any purpose concerning these Terms or the parties' obligations hereunder shall be brought exclusively in a court of competent jurisdiction sitting in the Canton of Fribourg, Switzerland.
